1. Agreement to Terms

By accessing or using GetPicked ("Service"), operated by Muni Muni Apps LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

GetPicked is an AI-powered interview practice platform that provides:

  • Simulated mock interviews conducted by artificial intelligence

  • Personalized feedback and evaluation based on your interview performance

  • Company and role-specific interview preparation

Important:

You are interacting with AI interviewers, not human beings. Our interviewers are computer-generated personas designed to simulate realistic interview experiences.

3. Eligibility

You must be at least 18 years old to use this Service. By using GetPicked, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information

  • Maintain the security of your account credentials

  • Notify us immediately of any unauthorized access

  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Voice Recording and AI Consent

By using our interview practice service, you acknowledge and consent to the following:

Voice Recording

Your voice will be recorded during interview sessions. These recordings are used to:

  • Generate transcripts of your interview

  • Provide AI-powered feedback and evaluation

  • Improve the quality of your personalized recommendations

AI Processing

Your interview data, including voice recordings and transcripts, will be processed by artificial intelligence systems to generate feedback. This includes third-party AI services.

Consent Mechanism

By clicking "Answer" or otherwise initiating an interview session, you consent to voice recording and AI processing. If you do not consent, do not initiate an interview session.

6. Credits and Payment

Credit-Based Model

GetPicked operates on a credit-based system. Each interview session consumes credits from your account balance.

Purchases

Credit packages are available for purchase. All purchases are processed through Stripe, our third-party payment processor. By making a purchase, you also agree to Stripe's terms of service.

Pricing

Current pricing is displayed at the time of purchase. We reserve the right to modify pricing at any time, but changes will not affect credits already purchased.

Refunds

All sales are final. Due to the digital nature of our service, purchased credits are non-refundable.

Exception: If a technical failure on our end prevents you from completing an interview session, contact us at hello@getpicked.ai for a credit restoration.

Credit Expiration

Credits do not expire while your account remains active.

7. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations

  • Impersonate any person or entity

  • Upload malicious content, viruses, or harmful code

  • Attempt to gain unauthorized access to our systems

  • Interfere with or disrupt the Service

  • Use the Service for any commercial purpose other than personal interview preparation

  • Record, redistribute, or publicly share interview content without permission

  • Reverse engineer, decompile, or attempt to extract our proprietary algorithms or AI prompts

  • Use automated systems (bots, scrapers) to access the Service

  • Share account credentials with others

8. Intellectual Property

Our Property

The Service, including but not limited to its design, features, AI algorithms, interview questions, evaluation methodologies, and proprietary prompts, is owned by Muni Muni Apps LLC and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Your Content

You retain ownership of the content you provide (resume, responses during interviews). By using the Service, you grant us a limited license to process this content solely for the purpose of providing the Service to you.

Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

9. No Employment Guarantees

GetPicked is a practice tool, not an employment service.

We make no guarantees, representations, or warranties that:

  • Using our Service will result in job offers or interviews

  • Our AI feedback reflects how actual employers will evaluate you

  • Interview questions will match those asked by specific employers

  • Your performance in our mock interviews predicts real interview outcomes

The "hiring signal" and evaluation ratings provided are AI-generated assessments for practice purposes only and should not be interpreted as professional career advice or predictions of actual hiring decisions.

10. Third-Party Services

Our Service integrates with third-party services including:

  • Vapi: Voice processing and AI conversation

  • Anthropic: AI language processing

  • Supabase: Data storage

  • Stripe: Payment processing

Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of third-party services.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free

  • Results from the Service will be accurate or reliable

  • Any errors will be corrected

AI-generated content may contain inaccuracies. You should use your own judgment when applying feedback to your interview preparation.

12. Limitation of Liability

To the maximum extent permitted by law, Muni Muni Apps LLC shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, data, or opportunities

  • Any damages arising from your use or inability to use the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Muni Muni Apps LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any rights of another party

14. Account Termination

By You

You may terminate your account at any time by contacting us at hello@getpicked.ai. Upon termination:

  • Your access to the Service will be revoked

  • Unused credits will be forfeited (no refunds)

  • Your data will be deleted in accordance with our Privacy Policy

By Us

We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:

  • Violation of these Terms

  • Fraudulent or illegal activity

  • Extended periods of inactivity

  • Requests from law enforcement

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms on our website

  • Updating the "Last Updated" date

  • Sending an email notification (for material changes)

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muni Muni Apps LLC regarding the Service and supersede any prior agreements.
